The city of Calimesa has filed suit in federal court against Everest Reinsurance Co. to secure completion of public improvements for the Oak Valley Town Center at Summerwind Ranch development project.
The city alleges that Everest breached its obligations under six performance bonds by failing to complete required improvements or surrender the penal sums specified in the bonds.
The development project is a 219-acre commercial and business park project between Singleton Road and Cherry Valley Boulevard, the Yucaipa/Calimesa News-Mirror reported.
The bonds cover various improvements, including:
- Street improvements
- Storm drain improvements
- Drainage facilities
- Onsite traffic signals
- Roberts Road culvert improvements
- Landscape improvements
The six disputed sums total to $19,862,367.
Calimesa claims it has fully performed its obligations and that Everest’s failure to perform has resulted in uncompleted improvements, causing damages to the city.
Calimesa seeks a determination of breach, damages, recovery of attorney’s fees and costs and other relief.
The complaint includes six claims for relief, each corresponding to a specific performance bond, and details the breaches and resulting damages for each bond.
