A proposed ballot initiative would replace the 2004 Labor Code Private Attorneys General Act (PAGA) with a law that places the California Labor Commissioner as the prime enforcer of labor law.
PAGA allows employees to sue their employer for labor law violations on behalf of other employees
Under the proposed changes, labor enforcement would not depend on court appearances, and subpoena enforcement would be optional.
The proposed law argues that enforcement of labor law “should not depend on backlogged courts, with lawyers charging exorbitant fees.”
