The California Court of Appeal rejected a former Indio police officer’s last bid attempt to regain his job after accusations of drunken driving and sexual assault.

Sergio Ramirez’ claim that an arbitrator’s recommendation should dictate Indio’s city manager’s decision is without merit, the court ruled in a published Oct. 10 ruling.

Ramirez was put on leave after he was charged with rape and sexual assault of his 18-year-old niece in 2016. A jury did not find Ramirez guilty after concluding trial in 2018.

According to the appellate ruling, Ramirez was also accused of driving drunk the night of the alleged assault.
