The Arrowhead Elks Lodge in San Bernardino lost its alcohol license on a final appeal Oct. 5 after a court ruled lodge personnel knowingly rented out their property for two unlicensed cannabis markets Aug. 15, 2018, and April 25, 2019.

Final appeal

A unanimous three-judge panel from California’s Fourth District Court of Appeal, Division Two, ruled the club’s type 51 nonprofit club license a retail license. Retail licensees cannot knowingly permit the illegal sale, or negotiations for the sales, of controlled substances or dangerous drugs upon their licensed premises, under California’s Business and Professional Code Section 24200.5(a).
