A former Mission Inn employee sued the Historic Mission Inn Corp. Nov. 30, alleging the company undercut break times and did not pay for employee’s time during coronavirus screenings.

Plaintiff Andrea Seas worked at the Mission Inn from March 29 until Aug. 3, according to her complaint.

The complaint

The Mission Inn failed to pay wages for employee’s hours while they lined up and waited for coronavirus screenings, the suit alleges. Since the total hours worked is increased by the screenings, sometimes more than eight hours a day, many employees are also owed overtime payments, the suit alleges.

The Mission Inn also required meal breaks 15 minutes after clocking in to a 10-hour shift, the suit alleges. California law requires meal periods after five hours of work.

The Inn also did not provide 10-minute breaks for employees working 3.5-hour shifts, the suit alleges.

The prior claims roll into the suit’s claim that the Inn did not pay timely earned wages during employment, did not have accurate wage statements, and did not pay employees all wages due at the end of employment.

Seas sued under the 2004 Private Attorneys’ General Act, which allows her to sue on behalf of other employees and the state in addition to herself.

Seas prays the court penalizes the Mission Inn.
