- Criminal: conviction in San Bernardino Superior Judge Michael Smith’s courtroom affirmed in People v. Zile (FSB19002378/D080382)
- Zachariah Zile appealed his conviction for murder. He had drunkenly slammed his car into an SUV at Interstate 210’s Highland Avenue Exit in 2019. Zile claimed the trial court erred by denying his motion to discharge a juror for talking with an employee of the district attorney’s office and by the court’s allegedly improper jury instructions. The Court of Appeal found that the juror’s discussion with the district attorney’s office was only with the juror’s close friend, who happened to work at the office, and only discussed the juror’s attraction to a man during trial.
- Civil: San Bernardino Superior Judge Donald Alvarez’s awarding of attorney fees affirmed in Blue Fountain Pools And Spas v. Zauss (CIVDS1715712/E077923)
- The Court of Appeal agreed with the trial court that attorney fees should be awarded to the prevailing party in an indemnification lawsuit. The court had awarded Lupe Zauss attorney fees after dismissing a case against her.
- Civil: appeal of Riverside Superior Judge Sunshine Sykes’s denial of arbitration dismissed in Garcia v. Clinicas De Salud Del Pueblo (RIC1905175/E077311)
- The Court of Appeal dismissed an appeal of the court’s denial of arbitration at the request of the parties. Clinicas De Dalud Del Pueblo operates medical clinics in California. Their employee, Lydia Garcia, sued them for claims unspecified by the Court of Appeal. The company moved to compel arbitration, but the court denied their request and the company appealed. The parties had requested the court dismiss it after the court published its tentative ruling.
