San Bernardino Superior Judge Joseph Ortiz granted a demurrer (Trujillo V. Kiddie Academy|CIVSB2206400)
- Ortiz threw out a case alleging a daycare center was responsible for a child’s skull fractures and bruises. Ortiz’s ruling says that the first amended complaint leads to confusion to the alleged injuries, and that the defendants were not named as a party in the contract the parents claim they broke.
Riverside Superior Judge Craig Riemer granted a demurrer (Pisciuneri v. Meneses|CVRI2201240)
- Reimer threw out Laura Pisciuneri’s case against former attorney Gene Meneses. Meneses was disciplined by the State Bar on July 9, 2022, and let his license lapse Jan. 28, 2022. Reimer had previously dismissed the case, but gave Pisciuneri leave to amend her complaint. His ruling found that she did not fix the issues Reimer had previously identified. She brought charges for negligent misrepresentation, intentional misrepresentation, the unauthorized practice of law and the intentional infliction of emotional distress.
Riverside Superior Judge Carol Greene denied a anti-SLAPP motion (Mesquite Country Club Condominium Homeowners Association V. Palms Partners Capital Llc|CVPS2203251)
- Greene denied a request to dismiss a lawsuit. The court found that the lawsuit was brought by a board’s failure to provide notice of a lawsuit, not by the board’s act of voting on the lawsuit as the board claimed.
