Jacob Magallanes, who pleaded guilty in San Bernardino Superior Court to lewd acts with a child, was sentenced July 28 to three years of supervised formal probation, with his sentence time already served.

The court ordered a 1,122-day sentence in county jail, but Magallanes had already served 1,952 days, or five years. The judge issued a criminal protective order to prevent Magallanes from contacting someone, on the same day.

Magallanes pleaded guilty June 15 to lewd or lascivious acts with a child. As part of the plea deal, prosecutors dropped the charge of sexual intercourse with a child 10 years or younger.

The court also ordered Magallanes to complete a sex offender treatment program.

Prosecutors claimed the lewd act took place Aug. 1, 2013. Prosecutors filed the case June 6, 2017, and the arraignment took place Nov. 26, 2019. The case was delayed June 2020, due to the COVID pandemic, according to the court access portal.

Sole practitioner Jesse Leija Valenzuela represented Magallanes.

The prosecutor was not identified on the court access portal.

San Bernardino Superior Judge Gregory Tavill presided.

Case number FSB17002197.
