Contract law

  • Krak Boba Franchising LLC v. 102 Boba LLC (5:24-cv-01760 ): diversity-breach of contract. Unassigned.
    • Riverside-based Krak Boba has filed suit against a franchisee, arguing it is using Krak Boba’s training, trade secrets and franchise system to create a competing boba shop in Minnesota. Krak Boba has 25 locations, including 19 in California, and shops in Texas, Indiana and Colorado. The company plans to open shops in Florida, Arizona, New Jersey, Nevada and Minnesota, according to their website. The complaint claims that their planned location in Brooklyn Center, Minnesota, has been subverted by their franchiser, who they alleged rebranded the location to 102 Boba.

Police

  • Manuel Zamudio, Jr. v. City of San Bernardino (5:24-cv-01747 ): civil rights. Unassigned.
    • Zamudio, a construction worker, claims that a man called in his San Bernardino police officer brother to harass Zamudio. Zamudio claims that Dennis Han lived next door to Zamudio’s worksite on East Miranda Road, and would complain about the noise. On Dec. 13, Han and Zamudio had an oral confrontation. After Zamudio left the worksite that day, he was followed by San Bernardino Police Officer Daniel Han, his complaint says. Daniel stopped Zamudio’s vehicle, on allegations that his license plate was obstructed, the complaint says. Daniel pulled Zamudio’s arm to drag him out of his vehicle, then handcuffed him, the complaint says. He brings claims of violation of his 14th and Fourth Amendment Rights, conspiracy, municipal liability, negligence and intentional infliction of emotional distress.
  • Adam Layne v. City of Hesperia (5:24-cv-01721): federal question: other civil rights. California Central District Judge Kenly Kato presides.
    • Layne sues Hesperia on allegations that an unnamed police officer unnecessarily assaulted him at his Orange Street home on Sept. 1, 2023.

ADA

  • Cameron Harrell v. Faura Commercial Holdings (5:24-cv-01731): Americans With Disabilities Act. California Central District Judge Jesus Bernal presides.
    • Harrell sues Wrightwood’s Canyon Creek Inn on claims that they did not provide an access aisle and did not properly paint its ADA-designated parking space.
  • Dennis Cooper v. Al Savin (5:24-cv-01742): Americans With Disabilities Act. California Central District Judge Dolly Gee presides.
    • Cooper sues an unidentified restaurant at 15207 Hook Blvd., Victorville, on claims that it did not provide a van accessible parking space and did not properly designate an ADA accessible parking space.
  • Theresa Brooke v. Sai Ram Inc. (5:24-cv-01749): Americans With Disabilities Act. California Central District Judge Fernando Aenlle-Rocha presides.
    • Brooke sues Econolodge Moreno Valley, at 14412 Sunnymead Blvd., Moreno Valley, on claims that its ADA-designated parking spot does not have an access aisle to ADA standards and that its disabled parking spot is too far away from the entrance. The parking lot is in a courtyard between the motel’s rooms.
  • Nelson Chilin v. AA Food, Inc. (5:24-cv-01757 ): Americans With Disabilities Act. Unassigned.
    • Chilin sues seafood distributor AA Food on claims that their main office at 3625 Placentia Ct., Chino, violates the ADA. He argues that its ADA-designated parking space does not have proper signs and was not properly painted, and that its access aisle was not wide enough. 
  • Harrell v. Mountain View Cabins LLC (5:24-cv-01758 ): Americans With Disabilities Act. Unassigned.
    • Harrell sues Mountain View Cabins, at 1098 CA-2, Wrightwood, on claims that it violates the ADA by not having disability-accessible parking spaces. Harrell attempted to visit in April of 2024, the complaint claims.
