  • Angela Smith v. City of Riverside (5:24-cv-02475): wrongful death. California Central District Judge Sunshine Sykes presides.
    • Angela Smith sues for the fatal shooting of her son, Ryan Smith, by Riverside police Dec. 6, 2023 outside of his girlfriend’s apartment complex. Smith appeared to have had a gun in the released police camera footage, but the complaint claims he did not. The police department released police camera footage of the shooting. The video shows two officers walking up to Smith’s car, and one of them immediately pulling out a gun and aiming it at Smith through his front window. “Don’t f— do it. Don’t you f— do it. Don’t f— do it. Just get your hand off the f— gun now. Get your hand off the f— gun now. Get your hand off the gun. Don’t you f— reach bro. Don’t you f— turn the car off,” before firing five shots. The camera footage does not give a clear showing of Smith’s hands. After he fell out of the car, a faint item fell out. The police identified the item as a weapon, and said a gun was found at the scene. Smith worked in the kitchen at Claremont College, and also freelanced as a tattoo artist, the complaint said. The suit brings claims of deprivations of civil rights, wrongful death, survivorship, negligent training and supervision, and negligence through inadequate screening.
  • Jonathan Fowler v. City of San Bernardino (5:24-cv-02467 ): Civil Rights Act. Unassigned.
    • Fowler and Lonnie Harris sue over the fatal police shooting of his father, Darrell Fowler, by San Bernardino police on Nov. 10, 2023. Fowler witnessed the shooting, and was a passenger in Fowler’s car when police stopped them. The complaint claims the traffic stop on 16th Street and Mount Vernon Ave. was illegal, without cause, and due to racial profiling. San Bernardino’s press release following the shooting said that Fowler did not have a valid driver’s license, and that Fowler had a gun. The complaint denies any knowledge of a gun. The complaint says police gave a pretextual claim that the car had a trouble with its tint and lights. After identifying himself, Fowler was told, “I know who the f— you are. Get the f— out the car,” according to the complaint, and then shot at after one officer yelled, “Gun, gun.”
  • T. S. v. Riverside Unified School District (5:24-cv-02480): violation of civil rights. California Central District Judge Sunshine Sykes presides.
    • Two students at Riverside’s Martin Luther King High School have sued the school on claims of First Amendment violations, due process violations, and Title IX violations. They claim the school gave preferential treatment to a transgender member of their cross country team, and that they were censored when they wore clothes to school that signaled their opposition to the teammate’s inclusion.
