Government defendant

  • Brooke Egger v. County of Riverside (5:24-cv-01439 ): transferred from county court – Civil Rights Act. Unassigned.
    • Egger sues on claims she should have been taken to a hospital instead of jail following her drunken car crash on May 6, 2023. Her complaint claims that Cathedral City Police Officer Mario Valdez declined to take her to a hospital due to his anger at cutting his arm on her broken window. She had a head injury and a concussion, her complaint says. Egger was released from the John Benoit Detention Center in Indio at 4 a.m. May 7, 2023. Her complaint says she was still drunk and concussed, and had received no medical care. She did not have a working phone, and she did not have her glasses. She was unable to find help, since it was early in the morning. She accepted a ride from a man who claimed to be an Uber driver, but who sexually assaulted her instead of driving her home, her complaint says. Her complaint brings five claims of violation of civil rights, one claim of failure to summon immediate medical care, and one claim of negligence.   • Norman Gainer v. County of San Bernardino (5:24-cv-01438 ): federal question: other civil rights. Unassigned.
    • The family of Ryan Gainer sue the county for their 15-year-old’s death by sheriff’s deputy shooting. Their complaint says that Gainer was fatally shot in their Apple Valley home following a March 9 911 call. Gainer, who was autistic, broke the glass in their front door after being told he could no longer play video games until he finished his chores. Gainer’s mother had called 911 for help. The teenager had apologized for his actions before officers arrived, and his sister made a second call to 911 advising them that the family no longer needed assistance. Sheriff Deputies Brandon Clancy and Wyatt Eisenbrey arrived after the second call. Gainer approached them with a frying pan in one hand and a garden hoe in the other. The deputies fired four shots at him, causing his death. The deputies then detained Gainer’s family. His family sues for excessive force, violation of the right to familial relationship, municipal liability, wrongful death, violation of the Tom Bane Civil Rights Act, assault, infliction of emotional distress, negligence, negligent infliction of emotional distress, denial of medical care, denial of access to public service, false imprisonment.   • Estate of Adam Preston Adams v. County of San Bernardino (5:24-cv-01447): Civil Rights Act. California Central District Judge Kenly Kato presides.
    • Adams’ family sues the county after his in-custody death on May 21, 2023. Adams was beaten to death by his roommate, Marco Lopez-Hernandez, the complaint claims. He was arrested for a non-violent misdemeanor on May 11, 2023, and housed in West Valley Detention Center in Rancho Cucamonga. Adams was schizophrenic, and Lopez-Hernandez was known to have a history of violence, the complaint claims. Court records show that Lopez-Hernandez was arrested for theft of personal property, resisting an officer and attempting to remove an officer’s gun. The case is ongoing (FWV23001178). Lopez-Hernandez was charged with murder. He pleaded not guilty, and the case is ongoing (FWV23001745). Six county inmates have died from inmate-on-inmate violence since 2018, and 26 inmates died in 2023, the complaint says. The complaint brings 10 causes of action, including failure to protect from harm, failure to provide medical care, deprivation of the right to familial relationship, municipal liability, wrongful death, medical malpractice and violation of the Tom Bane Civil Rights Act.   • Arturro Jordan v. City of Hemet (5:24-cv-01362): Civil Rights Act. California Central District Judge Jesus Bernal presides.
    • Jordan sues alleging excessive force used by Hemet police officers. The complaint claims Jordan was tackled, tased without warning, and restrained without cause in an apartment parking lot on May 2. Court records do not show that Jordan was charged following the encounter.
  • Christina Howell v. United States Postal Service (5:24-cv-01400): auto negligence. California Central District Judge Kenly Kato presides.
    • Howell sues on the claim that she was struck by a U.S. Postal Service truck that was pulling out of Ontario’s East Holt Boulevard postal facility.
  • Sherita C Lee v. West Valley Jail (5:24-cv-01386): prisoner civil rights. California Central District Judge Monica Almadani presides.
  • Devale Wright v. NeGrom (5:24-cv-01421): prisoner civil rights. California Central District Judge Dale Fischer presides.

ADA

  • Cameron Harrell v. Mountain Plaza Co. (5:24-cv-01423): Americans With Disabilities Act. California Central District Judge Jesus Bernal presides.
    • Harrell sues on claims that the strip mall Mountain Plaza Co., at 1601 N. Mountain Ave. in Upland violates the ADA by not having an access aisle with a level surface slope—the ramp to the strip malls was placed in the access aisle.
  • Cameron Harrell v. Richard O. Reed Post No. 777, The American Legion (5:24-cv-01446 ): Americans With Disabilities Act. Unassigned.
    • Harrell sues on claims that the American Legion post at 176 E. 40th St., San Bernardino, violates the ADA by not having a properly designated accessible parking space.
  • Cameron Harrell v. Upland Rajcic Brothers (5:24-cv-01363): Americans With Disabilities Act. California Central District Magistrate Judge Shashi Kewalramani presides.
    • Harrell claims that a business in a strip mall located at 940 N. Central Ave., Upland, violates the ADA by having a ramp installed on the van accessible aisle and by not properly designating the accessible parking space.
  • Cameron Harrell v. Sang Hyon Rho (5:24-cv-01378): Americans With Disabilities Act. California Central District Magistrate Judge Sheri Pym presides.
    • Harrell sues the owners of Meow Tea, a teashop in a strip mall at 1630 W. Foothill Blvd., Upland. She claims a permanent ramp installed on the van access aisle violates the ADA.

    • Harrell claims The Etiwanda Roadhouse Bar & Grill, at 12583 Highland Ave., Rancho Cucamonga, violates the ADA by not providing any disability-accessible parking.
