Court filing fees

  • Levi Lesches v. Anabel Z. Romero (5:24-cv-00524): declaratory judgment. California Central District Judge Kenly Kato presides.
    • Lesches, a Los Angeles-based attorney, is suing San Bernardino Superior Court and Los Angeles Superior Court’s executive officers on claims that the courts’ electronic filing procedure violates the California Code of Civil Procedure. He claims that the courts’ procedures, which reject court filings if the fees are incorrectly calculated, go against the code. 
    • The complaint says that both officers have “implemented significant improvements relating to electronic filing, remote appearances, scheduling hearings,” and that he did not intend to diminish their efforts. “This suit is not intended to criticize or penalize Defendant’s efforts to provide such improved access to justice. Indeed, Plaintiff anticipates that this suit will assist the Defendants in identifying (potentially unintended) reliability issues associated with their implementation of e-filing systems,” the complaint says.

Prison suits

  • Estate of Yareth Aguilar Villagomez v. County of Riverside (5:23-cv-01196): Civil Rights Act. California Central District Judge Stephen Wilson presides.
    • Yareth Aguilar Villagomez died of a drug overdose in the Smith Correctional Facility on June 20, 2022. Her family filed a case against the county, which was conditionally settled. The conditional settlement no longer stands, reopening the case.
  • Frances Enyart v. County of San Bernardino (5:24-cv-00526): Civil Rights Act. California Central District Judge Dean Pregerson presides.
    • The family of William Enyart, who died from alcohol withdrawal at West Valley Detention Aug. 1, 2022, is suing the county on claims of inadequate medical care.
  • Christopher Dylon Sawyer v. Riverside County (5:24-cv-00518): federal question: other civil rights. California Central District Judge Sunshine Sykes presides.
    • Sawyer, an inmate at Banning’s Smith Correctional Facility, claims he was blindsided and knocked unconscious by another inmate on Aug. 23, 2022. He claims his jaw was broken in two places, but was denied immediate surgery, and says he received inadequate health care. He claims he was further retaliated by being placed in solitary confinement for 10 weeks in response to grievances he submitted about his care.
  • Louis Hall III v. Riverside County (5:24-cv-00553 ): federal question: other civil rights. Unassigned.
    • Hall, a Robert Presley Detention Center inmate, claims his civil rights were violated by three allegedly excessive cavity searches between Aug. 1 and Aug. 15. He claims guards forced him to make sexual poses while nude, and that they made sexual advances and comments.

  • Dennis Cooper v. Luz Yanez (5:24-cv-00504): Americans With Disabilities Act. California Central District Judge Michael Fitzgerald presides.
    • Cooper, a paraplegic, claims that the Adelanto convenience store Saul Produce on Bartlett Avenue violates the ADA by not having parking signs up to ADA standards or an access aisle with a level surface slope.
  • Dennis Cooper v. World of Colors, Inc. (5:24-cv-00545 ): Americans With Disabilities Act. Unassigned.
    • Cooper sues this Victorville paint shop, on Tracy Street, on claims that it did not provide ADA-designated parking spaces.
  • Dennis Cooper v. Najjar Lube Centers, Inc. (5:24-cv-00538): Americans With Disabilities Act. California Central District Judge Jesus Bernal presides.
