  • Shameka Drye v. City of Hemet (5:23-cv-02152 ): federal question: other civil rights. Unassigned.
    • This complaint is brought by the family of Christian Drye, who was shot in his backyard by Hemet police officers in the morning of Feb. 21. The complaint claims that Drye was told by police that a man wanted for theft might be in his backyard. Drye told the police not to go into his backyard, that he had a firearm, and that he would check the backyard himself. When Drye checked the backyard, a police officer fired over Drye’s fence and fatally shot him. The complaint brings 13 claims, eight for civil rights violations and five for violations of state law.

  • Domingo Cruz Garcia Jr. III v. City of Hemet (5:23-cv-02130): Civil Rights Act. California Central District Judge Sunshine Sykes presides.
    • Cruz Garcia claims Hemet Police Officer Colby Skaug broke his jaw when arresting him Dec. 9. The complaint says that Cruz Garcia’s partner called in the police alleging domestic violence. Cruz Garcia argues that he was being arrested without cause. He also said police prevented paramedics from treating him, and that he needed surgery to repair his jaw.
  • Ricky Butler v. County of San Bernardino (5:23-cv-02147): Civil Rights Act. California Central District Judge Sunshine Sykes presides.
    • Butler brings claims for excessive force, equal protection violation and unlawful practice related to San Bernardino sheriff’s deputies’ actions on June 26, 2017. He claims Deputy Guyon Foxwell tased him without warning when responding to a call. Foxwell’s complaint says he was at an apartment requesting to speak with his son. The complaint says Foxwell was the third deputy to respond, and tased Butler within three seconds of appearing. The complaint also claims that Foxwell was asked why he tased Butler, and that Foxwell responded, “Because you are big and black. What did you expect us to do?” Butler was charged with three misdemeanors for resisting arrest, and a fourth for trespassing. The trespassing charge was dismissed for insufficient evidence and a jury did acquitted Butler of one of the charges for resisting an officer. He was convicted on the other two charges, and was placed on 30 days in county jail and a year of probation.
